2.I declare that all the particulars and information provided by me for availing this loan from BFL (“Loan”) are true, correct, complete and up-to-date in all respects and that I have not withheld any information whatsoever from BFL as may be required for availing loan from BFL.
3.I have an Existing Member Identification card (“EMI Card”) issued by BFL, which enables purchase of products or availing services including but not limited to apparel, holiday/travel packages, footwear, groceries, kitchen appliances and accessories from Vivo E-Store (shop.vivo.com/in), on Loan from BFL.
4.I have read and understood the Master Terms and Conditions applicable to loans for Consumer Durable, Digital, Life Style Products & EMI Cards available at: https://www.bajajfinserv.in/terms-and-conditions- ecomm.pdf (“Master Terms”), as are in force now or from time to time and agree to comply with and be bound by the said Master Terms.
5.I declare that all the documents required to be submitted for availing the Loan, shall be submitted by me to BFL in the form and manner as may be prescribed by BFL and the same shall be true, correct, complete and up- to-date in all respects.
6.I understand that in case the information given by me is found incorrect or false, then the same shall affect this Loan and all my future loan applications to BFL.
7.I understand that the Loan shall be assigned to me as per BFL’s sole discretion and internal policies and the same is subject to further revision at BFL’s sole discretion. BFL shall not be liable in any manner whatsoever for such revision or cancellation of Loan limit.
8.I understand and undertake to keep my credentials including the login id and password/PIN issued by BFL and/or reset by me (“Credentials”), as confidential and shall not share the same with any third party. Any use or misuse of the Credentials including the transactions carried out using the Credentials shall be my sole responsibility and BFL shall not be held responsible for any loss/damage incurred on account of such use, misuse and/or transactions.
9.I understand and acknowledge that transmission of information through internet is not a secure means of sending information and the same may be subject to tampering and unauthorized access, fraudulently or mistakenly written, altered or sent, and not be received in whole or in part by the intended recipient and which may affect the availability and performance of this online facility provided by BFL. I shall not hold BFL liable for any loss/damage, whether direct or indirect, arising out of or resulting from such tampering and unauthorized access, frauds, mistakes, etc.
10.I authorize BFL to exchange or share information and details relating to Loan to its group companies and other third-party agents/representatives as may be required or as it may deem fit for the purpose of facilitating this Loan application and/or related offerings or other products/ services that I may apply for from time to time. I shall not hold BFL (or any of its group companies or its/their agents/representatives) liable for use/sharing of such information.
11.I understand that by clicking the Confirmation Tab, I hereby provide consent for receiving communications from BFL, its group companies, agents/ representatives in relation to this Loan including promotional communications through any mode (including without limitation through telephone calls / SMSs / emails). I confirm that that I shall not challenge receipt of such communications as unsolicited communication, defined under TRAI Regulations on Unsolicited Commercial Communications.
12.I understand and agree that for concluding the Loan transaction for purchase of product/service from Vivo E-Store (shop.vivo.com/in), Rupees 49 as convenience fee (plus the applicable taxes) would be charged for each transaction and same would be added to my first equated monthly instalment for such Loan transaction.
13.I understand that products that are bought using EMI card from the Vivo E-Store (shop.vivo.com/in) are subject to the specific product cancellation policy of the Vivo E-Store (shop.vivo.com/in).
14.I understand that partial cancellation of any purchase made using Bajaj Finserv EMI within the cancellation period will result in the reduction of the tenure of the loan availed though the EMI amount will remain the same.
Terms and Conditions
“Jio vivo SUPER Offer”
2.“Eligible Device” shall mean 4G mobile devices of Vivo Mobiles India Pvt. Ltd. (“Vivo”) brand viz
(i) Z1 Pro purchased on or after 3rd July 2019 and activated for the first time on the RJIO network, by an Eligible Subscriber, on or after 3rd July 2019 by performing Recharge. The Offer is applicable only on the Indian version of the Eligible Device.
3.“Eligible Subscriber” shall mean a person who (i) has purchased the Eligible Device; (ii) is an active subscriber of the RJIO prepaid services; and (iii) is enrolled to the “Jio Prime” membership plan.
4.“MSISDN” means mobile station international subscriber directory number and for the purposes of this Offer, shall mean the mobile number assigned to the Eligible Subscriber for availing RJIO prepaid services.
5.“Partner Coupon Entitlement Period” shall mean the period between 3rd July 2019 and the expiry date mentioned against each coupon.
6. “Offer” shall mean this (i) Cashback made available by RRL; (ii) “Partner coupons” made available by RRL;
7.This Offer is applicable for prepaid customers of RJIO only.
8.“Offer Benefits” shall mean the benefits accruing to the Eligible Subscriber under the Offer as shown herein-below.
9.“Recharge” shall mean a recharge performed of Rs.299/- prepaid plan offered by RJIO.
10.“Recharge Cycle” shall mean validity period of 28 consecutive calendar days, starting from the date of activation of RJIO SIM, and subsequent periods of 28 consecutive calendar days each.
11.“RJIO” shall mean Reliance Jio Infocomm Limited.
12.“RRL” shall mean Reliance Retail Limited.
13.“T&C” shall mean the applicable terms and conditions of the Offer.
The Offer and the benefits hereunder shall be made available by RRL to an Eligible Subscriber.
Benefits of the Offer (“Offer Benefits”)
Cashback
An Eligible Subscriber, who, during the subsistence of the Offer, performs Recharge on or after 3rd July 2019 shall be entitled to Cashback.
Cashback received by the Eligible Subscriber shall be applied in the subsequent recharges used in the following manner:
•Each coupon of Rs. 150/- provided under the offer, can be applied by the Eligible Subscriber, upon subsequent Recharge in MyJio App only (“Eligible Recharge”);
•Only one coupon of Rs.150/- can be applied in the subsequent recharge per Eligible Recharge.
•A maximum of 40 discount coupons of Rs 150/- each, can be so applied on the Eligible Device by the Eligible Subscriber on or before 30th Sep 2022. For avoidance of doubt, all unused discount coupons shall expire on 30th Sep 2022.
Terms and Conditions of the Offer ("T&C")
1.The Offer is valid for Eligible Device purchased on or after 3rd July 2019 and activated on the RJIO network for the first time, on or after 3rd July 2019.
2.These T&C shall be read concomitantly with the terms & conditions of Jio Prime Membership and CAF.
3.Two or more offers cannot be clubbed together. This Offer cannot be used in conjunction with any other alternative offer or promotion of a similar nature. For avoidance of doubt, where an Eligible Device is activated/recharged under a subsisting cashback offer of RRL, this Offer shall not apply thereto. The decision of RRL/RJIO on the applicability of an offer to the Eligible Device shall be final and binding.
4.An Eligible Subscriber who have previously availed cashback offers provided by RRL for the Eligible Device shall not be eligible to avail this new offer.
5.RRL/RJIO recognizes that the choice to be contacted for promotional messages and alerts is that of the Eligible Subscriber. RRL/RJIO intends to keep the Eligible Subscriber informed on matters relating to the Offer and any upcoming offers from RRL/RJIO for the benefit of the Eligible Subscriber. Accordingly, by availing the Offer, the Eligible Subscriber hereby consents to be contacted by RRL/RJIO and such consent shall remain unaffected by Eligible Subscriber’s registration in the National Do Not Call (“NDNC”) registry under the relevant category stipulated therefor.
6.RRL reserves the right to cancel/withdraw this Offer at any time, without any prior intimation to the Eligible Subscriber. However, the benefits accrued to the Eligible Subscriber on or prior to the cancellation/withdrawal of this Offer, shall not undergo any change.
7.RRL, may, at its discretion, modify any of the terms and/or conditions and/or any aspect of the Offer, without any prior intimation to the Eligible Subscriber. The modifications so carried out will be posted on www.jio.com.
8.If any term/ condition under the T&C of the Offer is found to be invalid, void, or for any reason unenforceable, such term/ condition shall be severed from the other terms and conditions and shall not affect the validity and enforceability of the remaining terms and conditions of the Offer.
9.Any claims, issues, damages or losses with respect to the Eligible Device shall be the sole responsibility and liability of the manufacturer of the Eligible Device and RRL (including its affiliates, group companies or parent company) hereby disclaims, any and all claims, losses and liabilities, whether or not arising out of, or in connection therewith and / or this Offer and the terms and conditions governing the Offer. This disclaimer shall apply to the fullest extent permitted by law and shall survive cancellation/termination/determination of this Offer.
10.In no event shall RRL (including each of its affiliates, group companies or parent company) or its directors, officers, employees, agents or other representatives thereof be responsible or liable for any direct, indirect, special, incidental, consequential, or punitive damages, or any other damages of any kind, arising out of or related to the Offer.
11.The Offer Benefits are non-transferable.
12.The Offer can be availed only once per MSISDN & IMEI.
13.This Offer is subject to guidelines/directions issued by Telecom Regulatory Authority of India (TRAI), Department of Telecommunications (DOT) or any other statutory authority from time to time.
14.Eligible Subscriber hereby authorizes RRL/RJIO to collect his/her personal information including name, address and mobile number and share with its partners so as to enable the Eligible Subscriber to avail the Offer. 2. WHY MY ISSUING BANK CALL CENTER HAS NO INFORMATION ON EMI CONVERSION?
The issuing bank will receive EMI request after at least 3 working days of the transaction. Then issuing banks can provide status of transactions.
3. WHY HAS THE TRANSACTION AMOUNT NOT CONVERTED INTO EMI IN 7 WORKING DAYS?
Please contact your card issuing banks in-case 7 days have passed and transaction has not been converted in EMI. Conversion of transaction into EMI is at the sole discretion of card issuing bank and can also be rejected in unfortunate circumstances.
4. WHY IS THE FULL AMOUNT CHARGED IN MY BILL?
Please check transaction date and customer bill generation date, if the period is less than 7 working days then customer needs to speak to issuing bank to determine how much to pay. The bank might convert the EMI at a later date and change bill payment.
5. WHY THE SUM TOTAL OF EMIS IS MORE THAN THE TRANSACTION AMOUNT?
The issuing bank charges interest per EMI transaction. The interest rates are decided by the bank and are displayed at the time of completing the transaction.
6. WHAT HAPPENS IF BANK REJECTS EMI CONVERSION?
Customer needs to pay full amount of the transaction to the bank, since EMI facility is at sole discretion of the issuing bank. Or customer can refer to refund/return policy of the merchant.
7. WILL MY ORDER BE SHIPPED ONCE MY EMI IS APPROVED?
Once the payment is made, Vivo shall ship the product as per schedule and would not wait for the EMI approval.
8. WILL MY TRANSACTION AMOUNT BE REFUNDED IF THE EMI IS REJECTED
No refund will be issued in case the issuing bank rejects the EMI application since this EMI grant is at the bank’s sole discretion.
9. IF I QUALIFY TO GET A REFUND AS PER VIVO POLICY WILL I RECEIVE THE INTEREST ON IT AS WELL?
In case of refund, no interest payment will be borne by Vivo. Vivo shall return the transaction amount that was paid after the user returns the device in sealed condition.
10. WHOM SHOULD I REACH OUT TO IF MY EMI IS REJECTED
If offline EMI is rejected, user should take it up with issuing bank and not with Vivo. The customer will have to inquire about the status of their EMI request with their issuing bank.
11. CAN I CANCEL AN OFFLINE EMI TRANSACTION?
EMI transactions once submitted cannot be cancelled/reversed.
13. WHY HAVE I BEEN CHARGED WITH THE FULL AMOUNT OF THE TRANSACTION?

Active Subscriber shall mean a Subscriber who uses the Vodafone brand Subscriber Identity
Module (SIM) of VIL on a regular basis for purposes other than to participate in any offer or contest offered by VIL.

4. Eligible Subscriber shall mean an Active Subscriber who is a prepaid customer of VIL. An Eligible Subscriber must also satisfy the following criteria during the Offer period:
a. Subscriber must be an Indian citizen belonging to any one of the telecommunication service areas of VIL as mentioned herein;
b. Subscriber must not have been subject of any criminal proceeding;
c. Subscriber must not be of an unsound mind;
d. Subscriber must not be under any legal disability e.g. minority, insolvency, restraint by court order etc. and / or is otherwise prohibited from entering any contractual relationship.
(a). Upgrade/change to any new Vivo Z1 S1 Handset for the first time on Vodafone Network. That is Subscriberrs new Vivo Z1 S1 Handset (IMEI) has latched for first time, on Vodafone/iDEA network during the Offer Period.
C. OFFER DETAILS 1. DESCRIPTION, ELIGIBLE PRODUCTS, STEPS AND RESTRICTIONS
DESCRIPTION
a). The Eligible Subscribers fulfilling the eligibility criteria set above and successfully recharging 255/- recharge pack will be entitled for Rs.3750 Cashback in the form of 50 discountcoupons valuing Rs.75 each valid for 50 months which shall be effective from the date of credit.Also customer will get additionally 0.5 GB Data per day for 18 months .
b). The discount coupons shall be credited within 48 hours on the My Vodafone App/My Idea APP for the eligible new Vivo handset.
Steps for redemption Restriction:
c). Discount coupons can only be redeemed through My Vodafone App/My Idea APP only.
d). To redeem the discount coupon, customer has to go to the My Vouchers- Rs75 Handset Cashback section, in My Vodafone App /MY Idea APP click on Redeem Voucher button.
e). Redemption applicable only on the Eligible Products listed in the vivo Z1Pro Handset Cashback offer section.
f). Customer can only utilise one discount coupons of Rs.75 for one Eligible Product/s. Not more than one discount coupon can be redeemed on one recharge. Clubbing of voucher available to customer under various schemes cannot be done for one recharge.
g). Customer need to utilise at least one coupon within 60 days of the credit of the coupon otherwise the entire coupon worth Rs3750/- will get purged .
h). Discount coupons are applicable only on Eligible Product/s done for the same or the primary number on which the discount coupons are credited. Discount coupons cannot be utilised to recharge any other number other than the primary number are non- transferable.
i). Vivo Handset Cashback Offer can be availed only once on a Mobile Number.
j). Offer can be redeemed only once for the eligible handset. Any Handset (IMEI) that has become eligible once for the offer, cannot become eligible for the offer in future, even in case of a different mobile number.
k). Coupons will be forfeited in the event of churn, MNP (Port out) or in case migration to Postpaid. Unutilised coupons will be forfeited upon defined expiry (40 Months from date of credit).
D. OFFER PERIOD
This is a limited period Offer by VIL, available from 11th of July r19 00:00 hrs to 30th Septr19 23:59hrs. (Offer Period). VIL reserves the right to extend or shorten the Offer Period, as it deems fit.
E. OFFER AREA

F. MODIFICATION OF OFFER

b). If VIL modifies these Terms, the modified terms will be posted on vodafone.in. You are therefore advised to check this Website regularly for any update(s) or amendment(s) made to these Terms and Conditions and in the event the modified or amended Terms and Conditions are not acceptable to You, You should discontinue participating in the Offer. G. WITHDRAWAL OF OFFER

H. DISCLAIMERS
a. You agree that this Offer is being made purely on a best endeavour basis and subject to acceptance of these Terms and Conditions. VIL shall not be responsible for any loss, injury or any other liability to any Subscriber arising due to participation in the Offer.
b. VIL makes no representation or warranty of any kind whatsoever, whether express or implied, including, but not limited to, meeting of Your requirements or aspirations, timeliness, security of the Offer and/or any delay or failure to avail the Offer including due to technical or network problems. To the extent you choose to avail this Offer, you do so at your own initiative and You shall remain responsible for compliance with the Terms and Conditions herein, any applicable laws, including but not limited to applicable local laws. costs), losses or damages of whatsoever nature, which VIL may incur, pay or become responsible arising out of or in connection with the Your breach of these Terms and Conditions. VIL shall have the right to defend themselves, pursuant to this clause, at the cost of the Subscriber in breach.
1. GENERAL
a). This Offer cannot be used in conjunction with any other alternative offer or promotion of a similar nature.
b). By availing this Offer, You confirm and waive the applicability of rules and regulations of the National Do Not Call registry and You agree to receive promotional messages and alerts under the current Offer and upcoming offers from VIL, as it may in its sole and absolute discretion decide.
c). This Offer is subject to force majeure circumstances i.e. Act of God or any circumstance beyond the reasonable control of VIL.
d). The Subscriber shall also be bound by the terms and conditions of the Customer Application Form as amended from time to time.
e). This Offer is subject to guidelines/directions issued by Telecom Regulatory Authority of India (TRAI), Department of Telecommunications (DOT) or any other statutory authority from time to time.
f). The Terms and Conditions stated herein shall not override the terms and conditions of the Subscriber Enrolment Form/Customer Application Form.
g). Failure by VIL to enforce any of the Terms and Conditions in any instance shall not be deemed to be a waiver of those Terms and Conditions and shall not give rise to any claim by any person.
h). Subscriber may contact the customer care regarding any queries, complaints, disputes pertaining to the Offer.
i). You hereby authorize VIL to collect your personal information including name, address and mobile number etc. and share with its partners so as to enable You to avail the Offer. Your personal information will be stored and processed in accordance with Vodafone Privacy Policy which is available at http://www.vodafone.in/privacy-policy?section=consumer.
j). You agree that VIL has no responsibility and liability with regard to the privacy, safety and security of any information (including personal information) that You may have to share independently with third party content providers for availing relevant contents.
k). By participating in the Offer, You confirm to abide by all intellectual and industrial property rights, including copyrights or trademarks belonging to VIL and to any third party content licensor that is made available through the Offer.
l). These Terms and Conditions are governed in accordance with the laws of India. In the event of any disputes or any matter arising here from will be referred to a sole Arbitrator to be appointed by VIL whose decision shall be final and binding on the parties. The place of Arbitration shall be Mumbai.
